A Washington County judge upheld the Hagerstown City Council's decision to rezone a 3.6-acre property at the intersection of Eastern Boulevard and Potomac Avenue for agricultural use in a recent opinion, but took a humorous view toward the likelihood of future administrative or judicial action on the land. Evergreen Properties LLC, which owns the land, had planned to build a CVS pharmacy there. In 2001, the City Council voted to rezone the land from an agricultural use to a light business use, which would have allowed the pharmacy, but a neighborhood group appealed the decision to Washington County Circuit Court.

Rezoning requested for Food Lion construction Negotiations are under way to build a Food Lion supermarket in front of a proposed housing development along Sharpsburg Pike between Poffenberger Road and Battlecreek Boulevard. Developers presented an application to the Washington County Planning Commission and County Commissioners at a hearing March 9 to rezone 2.4 acres on the east side of Sharpsburg Pike to allow a store and a parking lot. They are asking the designation be changed from Highway Interchange 2, a high-density residential zone, to Highway Interchange 1, a high-density commercial zone.

DENNIS Staff Writer What would have been one of the largest rezonings in Washington County history fell short of that mark Tuesday night when the Washington County Commissioners refused to change the designation on more than half of the 611.5-acre Artz Farm. The Washington County Commissioners refused to rezone 376.8 acres of the property on Rench Road south of Hagerstown for industrial and commercial use. The County Commissioners, on a 3-2 vote, refused to rezone 276.8 acres to Highway Interchange 1. Commissioners President Gregory I. Snook cast the tie-breaking vote.

HAGERSTOWN - More than 800 acres recently annexed into Boonsboro edged closer to development Tuesday as the Washington County Commissioners approved the town's request for "express approval" to rezone them. The catch is that the total development will be limited to 1,640 new sewer service taps, and building permits will only be issued if the developments comply with the Adequate Public Facilities Ordinance. Boonsboro is under a state consent order to build a new water treatment plant by 2010 to comply with discharge permit requirements by the Maryland Department of the Environment.

H.B. Mellott Estates Inc. has asked a Washington County Circuit judge to remove conditions imposed by the Washington County Commissioners on a 79-acre rezoning the company needs to expand its Beaver Creek quarry. The conditions include putting a fence around the property, which would duplicate existing state regulatory requirements, Bronwyn Weaver, a Mellott spokeswoman, said Monday. County Commissioner Bert L. Iseminger said he does not care whether the conditions and regulations come from the county or the state as long as the company abides by them.

MARTINSBURG, W.Va. -Martinsburg city officials on Monday rezoned 232 acres along Delmar Orchard Road, a move that could allow several hundred homes to be built on the property, a city official said. The property is near Orchard View Elementary School. The property, which is owned by Oates Partnership, was annexed into Martinsburg four years ago, said Mike Covell, the city's planner and engineer. At that time, it was zoned community business, Covell said. Although the property was zoned for business, the property owners indicated they would do research on possible uses for the land, Covell said.

bonnieb@herald-mail.com GREENCASTLE, Pa. - The Greencastle Borough Council voted to approve a request from Orrstown Bank to rezone three lots in the Town and Country Subdivision along U.S. 11 near Antrim Way Honda to highway commercial, despite protests from nearby residents. The vote was unanimous, with Harold Duffey absent and Charles Eckstine abstaining. Several residents of the development voiced their objections to council members at a public hearing before the regular council meeting Tuesday evening.

waynesboro@herald-mail.com WAYNESBORO, Pa. - In one vote Monday night, the Washington Township Supervisors denied a request to rezone 2.89 acres for a 21-unit town house development. In another, they approved the rezoning of a larger tract, for a 161-unit town house development. Both parcels are in the township's west end. The motion to rezone the smaller tract on Polktown Road off Pa. 16 near the Tennis Club owned by All Side Inc. from commercial to medium density residential was denied because of potential stormwater runoff problems.

Several recent Herald-Mail editorials have asserted that Washington County's proposed rezoning is necessary to control local tax rates. According to the columns, if development continues under current zoning and regulations, the economic burden on each taxpayer will increase because more schools, roads, public water and sewer, law enforcement, emergency services, etc. will be needed to serve the growing population. This argument seems sensible; as the local population grows, local government spending must rise to maintain the same level of service.

HAGERSTOWN andrews@herald-mail.com A Hagerstown attorney argued Tuesday that an industrial zone off Howell Road should be changed to residential. Jason Divelbiss was representing Strategic Resources, LLC, of Highland, Md., which wants to build housing units on 28 acres owned by Dr. Richard Harrison of Hagers- town. After a public hearing Tuesday, the Hagerstown City Council took no action. The council will vote at a future meeting. If adopted, the rezone would take effect 45 days later, Mayor Richard F. Trump said.
