H.B. Mellott Estates Inc. has asked a Washington County Circuit judge to remove conditions imposed by the Washington County Commissioners on a 79-acre rezoning the company needs to expand its Beaver Creek quarry. The conditions include putting a fence around the property, which would duplicate existing state regulatory requirements, Bronwyn Weaver, a Mellott spokeswoman, said Monday. County Commissioner Bert L. Iseminger said he does not care whether the conditions and regulations come from the county or the state as long as the company abides by them.

Opponents of a decision to rezone land that H.B. Mellott Estates Inc. needs to expand have gone to court to block the move. Henry Heaton II, Roger Worthington and Neil A. Wright, who live near the mining company, petitioned a Washington County Circuit Court judge on Friday to block the rezoning. All three men are members of the Friends of Beaver Creek, a group that was formed in 1985 in an unsuccessful effort to block expansion of the quarry on its east side. The Washington County Commissioners voted 3-2 last month to rezone 79 acres in the northeast corner of the Md. 66-Interstate 70 interchange.

WASHINGTON COUNTY - The Washington County Commissioners correctly approved a zoning change that allows a quarry to expand, but they must explain part of their findings, a judge said in a written decision filed Monday. Washington County Circuit Judge John H. McDowell affirmed the commissioners' decision to place an industrial mineral floating zone over 80.33 acres zoned agricultural. However, McDowell sent the matter back to the commissioners and ordered them to explain their findings on where asphalt and cement batch plants will be within the zone.

MOUNT AETNA tarar@herald-mail.com Making good on their show of support last week for a zoning change that would allow a Mount Aetna-area quarry to expand, the Washington County Commissioners on Tuesday formally approved the request that has sparked organized opposition from residents of the area. But the County Commissioners also put several conditions on the quarry, including restricting its hours of operation, and requiring the business to outline the effects mining has on the surrounding water supply and to meet annually with concerned residents.

WARFORDSBURG, Pa. - A Buck Valley, Pa., man was injured Thursday morning when a car fell on him as he was working underneath it. A jack supporting the car apparently slipped causing it to fall on the unidentified man, pinning him in the neck and shoulder area, according to Needmore Volunteer Fire Company Dispatcher Eugene Mellott. The man's father, Jesse Cavender, used a loader from his sawmill to lift the car up, Mellott said. "That's probably what saved his life," Mellott said.

Quarry seeks Ok to remove water By SCOTT BUTKI scottb@herald-mail.com The Maryland Department of the Environment will hold a hearing May 8 on H.B. Mellott Estates' proposal to remove water at its Beaver Creek Quarry so it can work below the water table. As part of the plan, Mellott would provide emergency water supply for the nearby Albert Powell Trout Hatchery. Mellott is asking the state for permission to remove surface water and withdraw ground water to work below the water table at the west pit of its Beaver Creek Quarry, and would use the water to provide the trout hatchery's emergency water supply, said Mark Filar, chief water appropriations permits for MDE. As part of the proposal, Mellott has applied for permission to establish a "zone of dewatering influence" around both the east and west pits of the quarry.

tarar@herald-mail.com WASHINGTON COUNTY - For Crest Valley resident Charles Starliper, the Washington County Planning Commission's decision Monday night regarding a proposed quarry expansion was a "no-brainer. " The planning commission voted 4-0 to recommend that the Washington County Commissioners deny a zoning change that would allow H.B. Mellott Estate Inc. to increase its mining at Beaver Creek Quarry near Mount Aetna Road. It's up to the commissioners to reject or approve the requested zoning change.

Eleanor Lorraine Hoover, 87, of Hagerstown, Md., passed away Saturday, Aug. 24, 2013, at her home. Born Feb. 6, 1926, in Hagerstown, she was the daughter of the late Edgar Riley Hoover Sr. and Margie Irene Shreiner Hoover. She was a member of Salem Reformed Church and formerly a member of Bethel United Methodist Church for 50 years. She was employed by the Department of the Army at Fort Ritchie as a supervisor of accounting, retiring in 1986. She is survived by a brother, Ralph C. Hoover of Hagerstown; a sister, Nancy J. Longanecker of Canyon City, Colo.; 18 nieces and nephews; and numerous great-great-nieces and great-great-nephews.

William Sherman “Jack” Mellott, 96, of Williamsport, Md., passed away on Saturday, May 11, 2013, at Meritus Medical Center, Hagerstown, Md. Born Aug. 18, 1916, in Downsville, Md., to the late Russell Sherman and Lillie Estelle Davis Mellott. He was a 1934 graduate of Williamsport High School and attended Columbia College in Hagerstown. He was the postmaster at the Williamsport Post Office until his retirement. He was employed with the Postal Service for 35 years. He was a decorated veteran of the U.S. Army serving during World War II. He was a founding member of the Downsville Christian Church and helped to construct the church.
