WAYNESBORO, Pa. -- After a jury in Texas decides whether convicted killer Paul Devoe will be sentenced to death or to life in prison, the former handyman will be closer to returning to Franklin County, Pa. "It would be our intent to bring him back, no matter what his sentence is in Texas," Franklin County Assistant District Attorney Angela Krom said. Devoe, 46, is accused of killing Betty Jane Dehart, 81, in her State Line, Pa., home in August 2007. Prosecutors allege he stole Dehart's 2006 Hyundai and $8 as he fled Texas for New York.

julieg@herald-mail.com A man Hagerstown Police wanted in connection with a June shooting at Noland Village has agreed to waive extradition from New York to Maryland, Hagerstown Police Lt. Rick Johnson said he learned Thursday. Johnson said arrangements still had to be made to transfer Tariq Dane Small, also known as Richard D. Small and R Dot, from the New York Police Department in Brooklyn to Hagerstown. Hagerstown City Police have three arrest warrants for Small, 18, whose last known local address was 124 S. Prospect St., police said.

MARTINSBURG, W.Va. -- The man charged in the kidnapping and stabbing death of Katherine Nicole Sharp was returned to Berkeley County Wednesday from Winchester, Va., where he was being treated for gunshot wounds he received last week when correctional officers said he attempted to escape from them at City Hospital in Martinsburg. The Eastern Regional Jail's Web site said Donald B. Surber Jr., 37, of Winchester, was readmitted to the jail Wednesday at 3:25 p.m., less than 24 hours before his scheduled appearance in Berkeley County Magistrate Court this morning for a preliminary hearing on charges of first-degree murder and kidnapping.

BERKELEY SPRINGS, W.Va. -- A Morgan County, W.Va., man found 12 days ago in Miami and charged with his father's slaying was extradited Thursday to Eastern Regional Jail in Martinsburg, according to Morgan County Prosecuting Attorney Debra MH McLaughlin. Stephen J. Tamburo III, 39, of Shanghai Road in Berkeley Springs, is charged in Morgan County with first-degree murder and was being held without bond, McLaughlin said Thursday afternoon. McLaughlin did not know if Tamburo had an attorney.

A former Hagerstown man was extradited to the United States last week, five months after he was arrested in the Czech Republic, and charged with two counts of rape that allegedly were committed 10 years ago in Washington County. The incident involved a woman who was pinned down and struck numerous times in the head during an assault that lasted several hours, according to Washington County District Court records. Klaus Werner Vonmahr, 51, a German national who previously lived in Hagerstown, was booked at the Washington County Detention Center around midnight Friday, Assistant State's Attorney Joe Michael said Monday.

A Lancaster, Pa., woman charged with stealing tens of thousands of dollars from a Hagerstown couple while serving as a caregiver has been extradited to Washington County, the Washington County Sheriff’s Office said Thursday. Jackie Sue Carter, 51, was served with an arrest warrant for felony theft scheme $10,000 to $100,000; three counts of felony exploitation of an vulnerable adult; attempted felony exploitation of a vulnerable adult; and fraudulent misappropriation by fiduciary, according to a news release.

CHAMBERSBURG, Pa. -- Two tractor-trailer drivers charged in a 2007 pileup on the Pennsylvania Turnpike that killed two men could face extradition if they do not submit written waivers of arraignment in the next few days, officials said. Michael E. Ford, 55, of Venus, Texas, and Yu Anmin, 49, of San Gabriel, Calif., each were charged with two counts of homicide by vehicle in the Feb. 27, 2007, crash that killed James C. Skinner, 41, of Lower Burrell, Pa., and his passenger John Michael Taylor, 22, of Saltsburg, Pa. In February, charges against Ford and Anmin were reduced to reckless endangering another person.

Ex-St. James chaplain extradited to Washington County An Episcopal priest charged with molesting two boys at St. James School more than 15 years ago was back in Washington County Monday after being extradited from Illinois, Maryland State Police said. The Rev. Kenneth Behrel, 51, former pastor of St. Andrew's Episcopal Church in Grayslake, Ill., was being held on $30,000 bond on each for two counts of child abuse, police said. Behrel, the former chaplain at St. James, was arrested Feb. 6 on charges he molested two boys at the private boarding school near Hagerstown between 1981 and 1986.

The attorney for a man charged with murder who fought extradition from Great Britain for more than five years said Wednesday in Washington County Circuit Court that he wants his client's trial postponed, in part because many witnesses in the 2006 case have yet to be located. Joshua Edwards, 25, who was from Brooklyn, N.Y., was indicted in October 2006 in the July 23, 2006, fatal shooting of Jackson A. Rodriguez in a Washington Gardens apartment near Hagerstown. He was returned to Washington County in July after the European Court of Human Rights ruled that he could be extradited because the United States government had provided assurances that he would not face the death penalty.
