W.Va. DEP settles dispute with owners of mobile home park

MARTINSBURG, W.Va. — The operator of a sewage treatment facility for a Falling Waters, W.Va., mobile home park has agreed to pay a $55,530 penalty for multiple water pollution violations, according to a proposed settlement announced Monday.

The final settlement of an administrative consent order, which was signed last Thursday by Steven L. Rhoton of Williamsport, Md., is subject to comments received in a 30-day comment period that ends July 10, the West Virginia Department of Environmental Protection said in a public notice.

State environmental enforcement authorities documented multiple violations of Rhoton’s permit to operate an extended aeration package treatment plant at Broad Lane Mobile Home Park in 2009, 2011 and 2012, according to the consent order.

At the plant in April 2012, authorities noted 60 “exceedences” of Rhoton’s permit, including nine major violations, between the second quarter of 2009 and the first quarter of 2012, the consent order said.

In September 2011, state authorities found the stream at the discharge point for the treatment facility to be discolored and an increase in algae growth further downstream, the order said.

“An odor was noted near the receiving stream. Visible solids were observed on the receiving stream bed,” the order said.

Since June 2012, Rhoton has been working with Snyder Environmental Services, and the facility was immediately brought into compliance within effluent limits, the order said.

Snyder Environmental Services is to continue with operation and maintenance of the plant until it is hooked up to the Berkeley County Public Service Sewer District, the order said.

It also noted that the sewer district agreed to take over the facility by July 1.
