Hagerstown man pleads guilty to assault, indecent exposure involving 5-year-old

A Hagerstown man will be sentenced this summer following his guilty plea in Washington County Circuit Court on Monday to charges of assaulting and exposing himself to a 5-year-old girl.

Devon Naeem Davis, 22, of 317 S. Potomac St., pleaded guilty to second-degree assault and indecent exposure in exchange for the dismissal of other charges, including sex abuse of a minor and second- and third-degree sex offenses.

The two charges to which David pleaded guilty carry a maximum combined sentence of 13 years, but the state is seeking a time-served sentence, Assistant State’s Attorney Brett Wilson told Judge Dana Moylan Wright.

Davis, who had 195 days of jail credit in this case, was scheduled for sentencing on Aug. 22.

However, Wilson told Wright that Davis has warrants from Allegany County for violating probation on two cases. Allegany County issued warrants for Davis on a 2011 second-degree assault conviction and a 2012 conviction for having a handgun in a vehicle, court records said.

The girl was interviewed on Feb. 24, 2012, at the Washington County Child Advocacy Center and told investigators she had been molested and assaulted by the man while she was living at a local motel, according to the application for statement of charges filed by Maryland State Police.

For purposes of the plea hearing, Wilson told Wright that the girl would have been able to testify at trial that Davis had thrown her against wall on one occasion and had exposed himself to her on another.
