Hagerstown man charged with DUI in fatal W.Va. crash

Timothy Lee Kegarise is charged with one felony count in death of his brother

MARTINSBURG, W.Va. — The driver in a fatal vehicle crash on Hedgesville Road in October is accused of driving under the influence when the incident occurred, according to Berkeley County Magistrate Court records.

A warrant issued Tuesday charges Timothy Lee Kegarise, 32, of Hagerstown, with one felony count of driving under the influence in the Oct. 11 death of his brother, Thomas L. Kegarise, according to court records.

Thomas L. Kegarise, 34, also of Hagerstown, was pronounced dead at City Hospital in Martinsburg due to his injuries after the single-vehicle crash happened in the 9000 block of Hedgesville Road, police have said.

The deceased was a passenger in the front seat of a 2000 Kia Spectra driven by his brother, who was flown to Winchester (Va.) Medical Center for treatment after the crash, police have said. Frank Mason Jr. of Hancock, a passenger in the rear of the car, also was injured, police had said.

The car was traveling east on Hedgesville Road when it crested a small hill, crossed the center line and left the northern edge of W.Va. 9, striking a fence, police said. The vehicle continued for about 30 feet, then went airborne for another 50 feet before it struck a home at 9058 Hedgesville Road, said police, who were dispatched to the crash at 10:25 p.m.

The arrest warrant charging Timothy Lee Kegarise in the crash was requested by West Virginia State Police Trooper M.C. Morgan, who responded to investigate the fatal crash.

Police said in a news release after the crash they believed the driver was under the influence and that speed was a factor in the crash.
