MARTINSBURG, W.Va. — After deliberating for about two hours Tuesday, a Berkeley County Circuit Court jury found a 53-year-old man not guilty of sexually abusing a young girl about two years ago.
While cleared of two felony counts, Robert Lee Shade remains incarcerated in Eastern Regional Jail because he has yet to be prosecuted on similar charges filed against him in Frederick County, Va., Berkeley County Prosecuting Attorney Pamela Games-Neely said.
Shade was indicted by a Berkeley County grand jury in May 2010 on four counts of sexual abuse in 2008 and 2009, but Games-Neely said two of the charges were dismissed by the state because the victim, now 6 years old, was too young to remember what happened.
Some of the witnesses who testified in Shade’s trial this week are also linked to the Virginia case, Games-Neely said.
