Indictments handed down by Berkeley County grand jury

MARTINSBURG, W.Va. — The following individuals were indicted by a grand jury seated this week in Berkeley County Circuit Court. An indictment merely reflects a grand jury’s conclusion that the person probably committed the crime or crimes in question.


  • Antonio Prophet, 34, incarcerated at Potomac Highlands Regional Jail, Augusta, W.Va., on two counts of first-degree murder and one count of first-degree arson.
  • Robert W. Orr, 29, P.O. Box 236, Inwood, W.Va., on one count of transferring stolen property.
  • Larsha Jacobs, 36, incarcerated at Maryland Correctional Training Center, Hagerstown, on four counts of forgery of a credit card, two counts of uttering and one count of petit larceny.
  • Matthew A. Davis, 37, of 62 Carter Lane, Inwood, W.Va., on two counts of breaking and entering, two counts of felony destruction of property, and single counts of grand larceny and attempted grand larceny.
  • Clifton L. Flora III, 39, P.O. Box  444, Moorefield, W.Va., on two counts of breaking and entering, and two counts of petit larceny.
  • Rebecca Ferguson, 39, P.O. Box 1645, Falling Waters, W.Va., on eight counts of identity theft and 11 counts of child abuse resulting in injury.
  • Derrick L. Fillinger, 26, incarcerated at Eastern Regional Jail (ERJ), on counts of child abuse causing serious bodily injury, gross child neglect creating substantial risk of serious bodily injury, child abuse causing bodily injury and conspiracy.
  • Jessica N. Faircloth, 22, incarcerated at ERJ, on one count of driving under the influence resulting in death and four counts of fraudulent use of a credit card.
  • Joshua D. Slevin, 21, incarcerated at Huttonsville (W.Va.) Correctional Center, on two counts of forgery and two counts of conspiracy to commit uttering.
  • Victor L. Moten Jr., 27, incarcerated at Cresson, Pa., State Correctional Institution, on one count of possession with intent to deliver marijuana.
  • Randy E. Faircloth, 50, P.O. Box 650, Gerrardstown, W.Va., on one count of felony obtaining property in return for worthless check.
  • Montezz T. Lincoln, 26, incarcerated at ERJ, on one count of possession with intent to deliver cocaine.
  • Michael B. Stotler, 26, of 6620 Valley Road, Berkeley Springs, W.Va., on one count of possession with intent to deliver marijuana.
  • Jo Ann Bryan, 23, of 50 Wagner Drive, Martinsburg, on counts of child abuse causing serious bodily injury, gross child neglect creating substantial risk of serious bodily injury, child abuse causing bodily injury and conspiracy.
  • John G. Thompson, 22, of 4955 Toyer Road, Keedysville, Md., on one count of obtaining property in return for a worthless check.
  • Tracy L. Hensley, 42, P.O. Box 2025, Martinsburg, on 10 counts of fraudulent use of an access device.
  • Karen S. Boback, 44, incarcerated at ERJ, on two counts of child abuse causing serious bodily injury, two counts of child abuse causing bodily injury, two counts of gross child neglect creating substantial risk of bodily injury or death and one count of conspiracy.
  • Jesse A. Lafferty, 33, incarcerated at ERJ, on two counts of child abuse causing serious bodily injury, two counts of child abuse causing bodily injury, two counts of gross child neglect creating substantial risk of bodily injury or death and one count of conspiracy.
  • Amber R. Gunnoe, 23, of 6168 Martinsburg Pike, Shepherdstown, W.Va., on one count of child neglect causing bodily injury.
  • Rodney Theobal, 25, of 40 W. High St., Shepherdstown, on four counts of forgery and single counts of driving under the influence, obstructing an officer and providing false information to state police.
  • Jason M. Oakley, 32, of 39 Executive Drive, Hedgesville, W.Va., on counts of grand larceny, driving suspended non-DUI and possession of a controlled substance.
  • Ralph L. Mason, 48, incarcerated at ERJ, on two counts of threats of terrorists acts, and single counts of brandishing a weapon and assault.
  • Bryan K. Ansley, 46, incarcerated at ERJ, on one count of kidnapping, two counts of second-degree sexual assault and one count of burglary.
  • Nicola Blake, 34, of 11 Shoal Creek Court, Martinsburg, on eight counts of child abuse causing bodily injury.
  • Michael D. Stotler, 20, of 810 E. Moler Ave., Martinsburg, on counts of first-degree robbery, first-degree attempted robbery, conspiracy, burglary and malicious assault.
  • Michael S. Peck, 46, of 382 E. Burke. St., Martinsburg, on counts of first-degree robbery, first-degree attempted robbery, conspiracy, burglary and malicious assault.
  • James W. Wiles, 44, of 458 Cunningham Drive, Falling Waters, W.Va., on 58 counts of possession of child pornography.
  • Cathlynn A. Zimmerman, 38, of 2806 Emerald Road, Parkville, Md., on one count of embezzlement.
  • Jack L. Virts, 50, incarcerated at ERJ, on two counts of kidnapping, two counts of malicious assault and two counts of domestic battery.
  • William L. Kneisly, 27, of 2311 Gina Anne Court, St. Cloud, Fla., on one count of first-degree arson.
  • Mindy R. Lyes, 23, of 317 Janesa Drive, Martinsburg, on one count of embezzlement.
  • Gary O. Jones, 39, of 3864 Paynes Ford Road, Martinsburg, on two counts of driving revoked for DUI third offense, one count of fleeing while DUI  from a law enforcement officer and one count of fleeing from a law enforcement officer with reckless indifference.
