Police arrest two W.Va. men who had burglary tools with them

Two West Virginia men with tools in their possession were charged with burglary early Monday morning after a Hagerstown police officer saw them crouching in front of soda machine in the 100 block of Maryland Avenue, city police said.

Tevin Scott Varney, 42, 305 Apple Cross Road, Harpers Ferry, W.Va., and Thomas O'Brien Ferguson, 51, of 119 Robelei Drive, Martinsburg, W.Va., were charged with fourth-degree burglary related to the tools, Sgt. Jim Hurd said.

Officer Derek Marshall was patrolling in the area of the South End Shopping Center about 3 a.m. Monday when he noticed two men crouching in front of the vending machine, Hurd said.

Marshall also noticed there was a large black duffle bag lying near the men, Hurd said.

The men attempted to flee but Marshall was able to apprehend them with the help of Deputy Cody Rhodes of the Washington County Sheriff's Office, Hurd said.

It was discovered that the men had tools that would be used in a burglary, although there was no damage to the vending machine, Hurd said.
