Rape charge against Hagerstown man is dismissed

HAGERSTOWN --A charge of second-degree rape against a Hagerstown man was dismissed this week in Washington County District Court, according to court records.

Charges of fourth-degree sexual offense, second-degree assault and false imprisonment against Mark Proctor, 48, also were dismissed, records show.

The woman who filed the complaint told District Judge Dana Moylan Wright on Tuesday that she did not wish to proceed with the case. The woman said she had written a letter to the court, but she gave no other explanation of her reasons for wanting the case dismissed.

The woman filed the criminal complaint March 4, alleging that she was sexually assaulted on or about Feb. 13, according to court records.

The woman alleged she was asleep when Proctor assaulted her, records show.
