Ex-correctional officer pleads guilty to possession of child porn

MARTINSBURG, W.Va. -- A former officer at Martinsburg Correctional Center has signed an agreement to plead guilty to 10 counts of possession of child pornography, attorneys said Monday in Berkeley County Circuit Court.

Brian Lee Sine, 39, of Martinsburg, could be sentenced July 26, when 23rd Judicial Circuit Judge Gray Silver III is expected to decide whether to accept the agreement.

In April 2009, Sine was charged with 29 counts of possession of child pornography, according to Berkeley County Magistrate Court records.

As part of the plea agreement, Silver would have discretion in determining Sine's prison sentence and the attorneys would be free to argue the terms of the sentence.

In September 2009, Sine was sentenced in federal district court to 41 months in prison after he entered guilty pleas to two counts of an indictment charging him with counterfeiting and possession of child pornography. Upon completing the sentence, Sine is expected to be placed on 10 years of supervised release.

Sine's arrest stemmed from a West Virginia State Police investigation in 2007, when he and another former correctional center officer were arrested on multiple counts of counterfeiting, according to court records.

Police found pornographic video files on his laptop computer while investigating a wire fraud scheme involving the counterfeit money and a "lady from Africa," according to court records.
