Berkeley Co. man gets up to 190 years for sexual assault

MARTINSBURG, W.Va. -- A 41-year-old Berkeley County man convicted of sexually assaulting a 10-year-old girl was sentenced Monday to serve 55 to 190 years in prison.

The victim, now 12 years old, wiped tears from her eyes as Freddy Cornell Lavender was sentenced by 23rd Judicial Circuit Judge Gray Silver III, who said the defendant showed no mercy or remorse for his actions.

In July, a jury found Lavender guilty of one felony count of first-degree sexual assault and four counts of sexual abuse between November 2006 and March 2008.

The victim told authorities that she was sodomized on March 9, 2008, according to a police complaint filed against the defendant.

A nurse at City Hospital in Martinsburg told police she found evidence of bruising and tears that were consistent with forcible sodomy and the victim would need antibiotics to recover from the injury, according to court records.

On the witness stand in his trial, Lavender testified that he did not know how his body fluid was found on one of the victim's shirts.
