Ex-Roxbury officers slated to be in court

HAGERSTOWN -- Six former Roxbury Correctional Institution officers charged with second-degree assault in connection with the beating of an inmate are scheduled to be in Washington County Circuit Court Monday.

Robert Harvey, 63, Tyson Hinkle, 34, Scott Boozel, 28, Keith Morris, 27, Michael Morgan, 39, and Dustin Norris, 25, are expected in court for a hearing at 9 a.m. today.

The hearing is to request a continuance of the cases beyond the 180 days from the initial charging, as required by law, Deputy State's Attorney Joseph Michael said Friday.

The state's attorneys office is not prosecuting the cases, but did schedule the hearing. The Attorney General's office is prosecuting the officers.

Nine former officers originally were charged in February. Prosecutors in June dropped charges against Reginald Martin, 38, of Chambersburg, Pa.

Timothy Mellott, 23, of Woodbridge, Va., and Lucas Kelly, of Frostburg, Md., agreed May 26 to testify against their former colleagues as part of a plea agreement.

A trial against Boozel ended June 16 with a hung jury, and a judge declared a mistrial.

Trial dates will be assigned today, Michael said. He said he expects the cases to go to trial in September or October.
