Two indicted on incest charges in W.Va.

Twenty-five more people were indicted on various charges Wednesday as a Berkeley County grand jury wrapped up following two days of deliberations.

Listed among the indictments were five counts of sexual abuse in the first degree and two of sexual abuse by a parent, guardian or custodian against a 33-year-old Martinsburg man in a case involving an 11-year-old girl.

In keeping with Herald-Mail policy, the defendant's name and that of the victim are not being published to protect the victim's privacy.

In a similar, but unrelated case, a 27-year-old Martinsburg man was indicted on one count of sexual assault in the first degree in a case involving a 9-year-old-girl.

Four men were indicted on charges stemming from violations of the law requiring convicted sex offenders to register with the state police.

Indicted were:

o Russell G. Hopkins, 38, of 42 Crown Court, Martinsburg, one count of failure to notify of a change in residence, of employment and one of failure to report.

o Stanley M. Myers, 57, of 13463 Apple Harvest Drive, Martinsburg, one count of felony failure to register as a sex offender and a misdemeanor count of contributing to the delinquency of a minor. According to court records, Myers was using a false user name on an e-mail site.

o Woodrow J. Smith, 29, of 33 Pit Lane, Martinsburg, one count each of failing to register with the state police as a sex offender and failure to notify police that his residence changed.

o Randy A. Bower, 34, of 38 Boarman Place, Martinsburg, indicted on one count of failure to register as a sex offender with the state police.

Also indicted Wednesday were:

o Russell Coates Jr., 51, whose address is listed as the Eastern Regional Jail in Martinsburg, was indicted on one count of kidnapping and nine counts of sexual assault in the second degree. Coates also was indicted on one count of delivering cocaine.

o Nelson D. Rodriguez, 29, Eastern Regional Jail, was indicted on one count each of attempted murder and malicious assault.

o Crystal J. Wells, 25, of 20 Brigadier Circle, Martinsburg, one count of delivering cocaine.

o Ivory M. Shedd, 23, of 245 Roberts Drive, Martinsburg, one count of delivering cocaine.

o John P. Peacher, 32, 313 W. Adams St., Martinsburg, one count of delivering cocaine.

o Ruby L. Robinson, 51, of 1201 Grebe Court, Martinsburg, one count of delivering cocaine.

o Kasem D.Humphrey, 23, Eastern Regional Jail, possession with intent to deliver cocaine.

o Donna Boward, 43, of 233 Blair St., Martinsburg, one count of embezzling. According to court records, the case involved the Elks Lodge 778 and more than $11,000. Boward was an employee of the lodge, court records said.

o Lanish A. Bailey, 23, of 501 W. King St., Martinsburg, indicted on a single count of felony child neglect creating substantial risk of serious bodily injury.

o Chad W. Phillips, 26, of 210 Crawford Quarry Road, Falling Waters, W.Va., one count each of forgery, uttering and domestic battery third offense.

o John E. Labbe Jr., 37, of 79 Flat Lane, Bunker Hill, W.Va., two counts of uttering.

o David C. Brode Jr., 30, of 42 Big Spring Drive, Kearneysville, one count each of forgery and conspiracy.

o Angela R. Shirley, 31, of 561 Hidden Hollow Drive, Kearneysville, one count each of uttering and conspiracy.

o Michael K. Silver, 40, of 874 Wisteria Lane, Berkeley Springs, W.Va., one count each of DUI while revoked, false information to a police officer and no inspection sticker.

o Jamie R. Koontz, 22, of 10045 Winchester Ave., Bunker Hill, one count each of breaking and entering, grand larceny and felony conspiracy.

o Kyle B. Koontz, 24, Eastern Regional Jail, two counts  of breaking and entering and one count each of grand larceny, felony conspiracy and petit larceny.

o Amber N. Jones, 23, Eastern Regional Jail, and Denis W. Jones Jr., 22, Eastern Regional Jail. Both were indicted on one count each of robbery in the first degree and felony conspiracy in a case involving the robbery of a local fast-food restaurant in which an employee was pushed to the floor, court records said.

o Sabrina J. Harris, 41, of 1429 Carroll St., Brooklyn, N.Y., one count of grand larceny in a case involving the theft of household goods valued at more than $13,000 and one count of felony destruction of property.

o Douglas W. Derflinger, aka Wayne C. Derflinger, 40, of 24 Harranda Court, Inwood, one count each of burglary, grand larceny and felony conspiracy.
