Pizza shop owner's case forwarded

The case involving a Hagerstown pizza shop owner who allegedly scuffled with city police over an underage alcohol incident will be forwarded to Washington County Circuit Court, court officials said.

Frank J. Picone, 42, owner of Rocky's Pizza at 907 S. Potomac St., asked for a jury trial Tuesday in Washington County District Court, court officials said.

A trial date will be set in circuit court, officials said.

Picone shouted curses at city police and scuffled with them in his restaurant Jan. 9 after he was informed beer had been served to an underage woman, according to allegations in a Hagerstown Police Department report.

Picone was charged with resisting arrest, obstructing and hindering, disorderly conduct and possession of marijuana, according to court documents.
