Charge against teacher dismissed

MARTINSBURG, W.Va. -- A misdemeanor battery charge filed against a Berkeley County physical education teacher after an alleged locker room altercation with a Martinsburg North Middle School student last fall has been dismissed.

The student and his guardian signed a formal request Wednesday in Berkeley County Magistrate Court asking the state to dismiss the charge against Richard B. Moore, Assistant Prosecuting Attorney Stephanie Saunders said.

School administrators have not yet discussed Moore's employment status since the charge was dismissed, school district spokeswoman Jaimee Borger said.

Moore, 45, was placed on administrative leave with pay by the school district after an altercation involving a 14-year-old boy that was reported to have happened Sept. 22, 2008.

After his client was arraigned in October, attorney B. Craig Manford had said he was confident his client, who coached basketball in the school district for 21 years, would be acquitted.

The boy had told police the teacher grabbed him in the boys locker room during a seventh-period class, according to court records.

The boy had bruising on his chest and scrapes on an elbow, according to a police complaint.
