Man arrested in W.Va. shooting

MARTINSBURG, W.Va. -- A man was in Eastern Regional Jail Wednesday after police said he admitted to shooting another man in the leg during an apparent domestic altercation Tuesday night, according to Berkeley County Magistrate Court records.

David Russell Bussard, 34, of 267 Broadview Court in Falling Waters, W.Va., was arraigned on charges of malicious wounding and wanton endangerment by Magistrate JoAnn Overington who set a $25,000 cash-only bond, according to court records.

Berkeley County Sheriff's Department Deputy R. Grove said in a complaint he interviewed the victim, David Allen Moye, at City Hospital in Martinsburg after the shooting at the victim's mobile home off Broad Lane.

A City Hospital spokesperson would not release any information on Moye's treatment or medical condition.

Grove said in his complaint he and six other deputies responded to investigate the shooting after receiving a call at 11:22 p.m. He said the gunshot wound was in Moye's upper left thigh.

Moye said he had been arguing with "his old lady" before the shooting, according to Grove's complaint.

Moye said he was in his bedroom when Bussard called his name, then fired a handgun three times, once aiming the weapon directly at Moye after he responded, Grove said in his complaint.

Bussard was arrested by deputies while leaving the home and was found with a SIG Sauer .40-caliber handgun that fell to the ground while he was being detained, according to Grove's complaint.

Inside the residence, police found bullet holes in walls and one that went through a water heater.
