W.Va. woman waives hearing in neglect case

MARTINSBURG, W.Va. -- The first court appearance for a mother charged with child neglect after her 2-year-old girl was found shoeless and without a coat last month on a cold and wet Martinsburg street will be rescheduled.

Lanish A. Bailey, 23, of 501 W. King St., Apt. 4, in Martinsburg, who was charged with two felony counts of child neglect, waived her right Friday to have a preliminary hearing in Berkeley County within 20 days of her arrest.

The young girl was found Oct. 28 about 3 a.m. in the 300 block of South Water Street, police said. She was briefly exposed to the elements and was not injured, police said. The girl and Bailey's 4-year-old daughter later were placed in the custody of the West Virginia Department of Health and Human Resources.

A Water Street resident told police that after hearing a loud car radio and a woman scream outside their home, the girl was seen running after a car speeding toward East Stephen Street, police have said. A child safety seat also was found along the street.
