How it works

Each month, The Herald-Mail publishes the findings of initial food establishment inspections by the Washington County Health Department. Food service facilities are inspected on a regular basis to make sure they are following the regulations that govern such establishments.

Inspectors also conduct follow-up inspections and monitoring inspections, and investigate complaints and food-borne outbreaks.

Potentially hazardous food means any food rich in protein that will support the rapid growth and reproduction of food-borne disease microorganisms.

Inspections are conducted at restaurants, nursing homes, schools, grocery stores and other places that serve food, including those that only are temporary such as fairs and carnivals.


Critical violations such as contaminated or spoiled food, improper temperatures of foods, improper cooking or no running water must be corrected immediately. Those items are marked with *.

Other violations must be corrected within 30 days. Follow-up inspections will be conducted as needed.

Those violations corrected on day of inspection are indicated as (corrected).

The following food service establishments were inspected by the Washington County Health Department in September and found to have critical violations that needed to be corrected immediately.

Bavarian Pretzel Bakery, Valley Mall, Hagerstown -- * must have hot water in employee restroom (corrected); shelving and floors must be cleaned.

Chuck E. Cheese, 17618 Valley Mall Road, Hagerstown -- * food not cold enough in small refrigerator (discarded); sanitizer levels too low (corrected); chemical test strips must be available (corrected); ice machine drain must be cleaned (corrected); employee drinks cannot be on mixer (corrected).

Darrell Enterprise Asian Market, 17609 Virginia Ave., Hagerstown -- * fish cannot be repackaged from original damaged package (removed from sale); damaged floor tiles must be replaced; restroom must be cleaned; stained ceiling tiles must be replaced; ventilation cover in restroom must be cleaned.

Fireside Restaurant and Lounge, 1716 Underpass Way, Hagerstown -- * dented can of apple butter (removed from shelf); floor under dish machine must be cleaned (corrected); inadequate air gap at dish machine.

Food Lion, 17718 Virginia Ave., Hagerstown -- * severely dented cans on shelf (removed); restroom exhaust vents in need of cleaning; hand sink cannot be blocked (corrected); restroom faucets not timed properly; leaky pipe and bakery preparation sink must be repaired; defrosting needed under freezer compressor; hole in ceiling must be sealed; floor tile must be repaired; walk-in thermometer must be repaired.

Holiday Inn/Express Hotel Suites, 241 Railway Lane, Hagerstown -- * dented can of sausage gravy (corrected).

Jim's Concession, 21123 Leitersburg Pike -- * water must be restored to three-compartment sink and hand sink (corrected); surfaces must be smooth and cleanable; exhaust hood must be cleaned (corrected).

Nikko Japanese Seafood and Steak House, 1580 E. Wesel Blvd., Hagerstown -- * sauces not hot enough (corrected); * salad dressing not cold enough (corrected); floors must be cleaned; chemical test strips must be available; soap needed at hand sink; scoops must have handles to prevent contamination.

No. 1 Chinese Restaurant, 17608 Garland Groh Blvd., Hagerstown -- * shrimp, ribs, chicken and egg rolls not kept at proper temperature (food dumped); * soy sauce contaminated with water from three-compartment sink (corrected); wiping cloths must be kept in sanitizer; floor mop cannot be kept in hand sink; exhaust vent filters, floors and refrigerator must be cleaned; food improperly stored; empty can cannot be used as scoop; cracked and broken floor tiles must be replaced; splash guard needed at hand sink; inadequate sanitizer level in three-compartment sink; rice cannot be stored uncovered; hazard plan must be available; chemical test strips must be available; thermometers needed in all units.

Riehl's Bakery, 1583 Potomac Ave., Hagerstown -- * dented can stored with usable cans (corrected); lights must be shielded; bakery items cannot be stored unprotected (corrected).

Sav-A-Lot, 1161 Maryland Ave., Hagerstown -- * 20 cans of infant formula past the sell-by date (removed); working thermometers needed on display cases; missing light must be replaced; vent in restroom must be cleaned; damaged ceiling tiles must be fixed.

Tony's New York Pizza, 14224 Pennsylvania Ave., Hagerstown -- * severely dented cans on shelf (removed); food cannot be stored on floor of freezer (corrected); garbage container must be covered (corrected); freezer floor, refrigerator, can opener, exhaust hood filter, light shields, soda dispenser and restroom vents must be cleaned; faucet timing must be adjusted.
