W.Va. man waives right to hearing in accidental death case

MARTINSBURG, W.Va. - A Bunker Hill, W.Va., man charged in the death of a 27-year-old woman in an alcohol-related accident March 9 waived his right Tuesday to a preliminary hearing in Berkeley County Magistrate Court.

Ricky Luther Corbin, 24, briefly appeared before Magistrate Harry L. Snow with his attorney, Nicholas F. Colvin. Corbin is charged with one felony count of driving under the influence causing death.

Police said Corbin wrecked a red Dodge Durango carrying four passengers, including Dawnelle Renee Hutzler of Inwood, W.Va., who was found dead at the accident scene in the 1500 block of Hatchery Road, police said.

Corbin was arraigned on three misdemeanor counts of DUI causing injury. A preliminary hearing in magistrate court for those charges is scheduled for Sept. 8.

By waiving the hearing, Corbin automatically allowed the Berkeley County Prosecuting Attorney's office to present the state's evidence to a grand jury to decide whether to indict the defendant.
