Smithsburg zoning board members protest failure to reappoint member

July 02, 2008

SMITHSBURG - Two members of the Smithsburg Zoning Appeals Board addressed the Smithsburg Town Council on Tuesday night to protest the council's failure to reappoint the mayor's husband, Homer Myers, to the board.

A motion to approve Myers' reappointment died for lack of a second at the council's June meeting after council members Donnie Souders Jr., Dennis "Jack" Wenthe and Jerome Martin said they thought it would present a conflict of interest for Myers, a major property owner in the town, to serve on the board.

Current zoning and appeals board member Kevin Jeter said the board as a group felt Myers served the town well and his level of experience was irreplaceable. Dee Hockensmith, another current board member, implied the decision was based on "personal feelings and unfounded allegations," and said she would resign from the board if Myers was not reappointed.

Hockensmith said that using the council members' reasoning, Martin's position as a liaision to the Planning and Zoning Commission would also be a conflict of interest because Martin owns a general contracting business.
