Fairplay man charged with drinking while boating

A Fairplay man was charged Sunday with operating a vessel while under the influence of alcohol, Maryland Natural Resources Police said.

Frederick S. Cade III, 37, was arrested in the area of Dam No. 5 on the Potomac River, officers said in a news release.

Cade was in court earlier this year, fighting his neighbors over a winning $1 million lottery ticket.

Cade sued Brian S. and Mary Lee Kendle on Jan. 25, 2007, claiming that he and Brian Kendle, 38, bought a "Countdown to Millions" lottery ticket at McNamee's Tavern on Dec. 15, 2006, with the agreement that they would split any proceeds.

Following a three-day trial in February, during which 30 witnesses testified, a six-person jury deliberated for less than 30 minutes before awarding ownership of the ticket to the Kendles.

On Sunday, National Resources Police officers were assisting National Park Service rangers with an underage alcohol complaint on the C&O Canal towpath when they stopped Cade.

Cade was released Sunday on his own recognizance.
