Berkeley County grand jury indicts woman accused of shooting husband


MARTINSBURG, W.Va. -- A woman accused of shooting her estranged husband five times in September 2007 and a man who police said took part in the execution-style homicide of another man two years earlier in Martinsburg were indicted Wednesday by a Berkeley County grand jury.

Maria L. Decicio-Smith, 35, of 210 Gussie Ave. in Martinsburg, and Kurtis M. Pearsall, 24, aka "Prince" and "Kurt the Flirt," each were indicted on one count of murder, according to indictments released by Berkeley County Prosecuting Attorney Pamela J. Games-Neely's office.

The indictments were among 15 that jurors decided in a second day of proceedings in Berkeley County Circuit Court. Thirty people have been indicted during the first two days.

The panel is expected to reconvene today, officials said.

Decicio-Smith was arrested Sept. 15, 2007, in connection with the shooting of Richard E. Amundson at her home. She was placed on home confinement after 23rd Judicial Circuit Judge Christopher C. Wilkes agreed in December to set a $50,000 bond.


Individuals charged with murder typically are held in jail without bond until their case is adjudicated.

Pearsall is in Roxbury Correctional Institution near Hagerstown, where he is serving a prison sentence stemming from a drug dealing-related charge that was filed against him in Allegany County, Md., after the Oct. 25, 2005, shooting of Donald Lee Redman in Martinsburg.

Also indicted Wednesday were:

· John F. Wilt, 44, of 794 Royal Crest Drive in Martinsburg, on three counts of shoplifting third offense in November 2007.

· Richard K. French, 44, of 458 Fox Glen Road in Kearneysville, W.Va., on counts of embezzlement and conspiracy between May 2003 and December 2005.

· Erica R. French, 40, of 458 Fox Glen Road in Kearneysville, on counts of embezzlement and conspiracy between May 2003 and December 2005.

· James R. White, 47, aka Stanley Sampson, aka Thomes Willis, of 35 Boarman Place in Martinsburg, on counts of driving under the influence third offense, driving revoked for DUI, obstruction of an officer and false information to a police officer in November 2007.

· Gregory Huggans, 45, of no fixed address and in jail since January 2006, on one count of domestic battery third offense in January.

· Wesley C. Greer, 21, of 305A S. Main St. in Keyser, W.Va., on three counts of wanton endangerment and one count of DUI in September 2007.

· Davon L. Fletcher, 20, of 102 Eclipse Court, Apt. 4, in Martinsburg, on one count of embezzlement between August and September 2007.

· John P. Valentine, 19, no fixed address, on two counts of first-degree robbery and counts of wanton endangerment and conspiracy in August and November 2007.

· Gerald T. Grance, 45, of 11778 Old 126 in Crystal Spring, Pa., on one count of obtaining money by false pretense in May 2007.

· Derrious J. Brown, 22, aka "Mississippi," of 114 Fairlawn Garden No. 2 in Martinsburg, on counts of malicious wounding and wanton endangerment in January.

· Robert A. Poffenberger Jr., 24, aka "Swiss," of 69 E. Antietam St., Apt. 2, in Hagerstown, on counts of wanton endangerment, felon in possession of a firearm, reckless driving, driving while license suspended for non-DUI, fleeing on foot, improper registration, obstruction and assault on a law enforcement officer in August 2007.

· David L. Ferguson, 55, aka "Sneeze," of 706 W. Martin St. in Martinsburg, on counts of possession with intent to deliver crack cocaine and conspiracy in September 2007.

· A Bunker Hill, W.Va., man was indicted on counts of first-degree sexual assault and sexual abuse in January 2007.
