Hagerstown man charged with rape pleads guilty to assault

A Hagerstown man who faced a rape charge pleaded guilty Thursday in Washington County Circuit Court to second-degree assault.

Anthony Hoang Nguyen, 33, assaulted a woman who tried to break off a relationship with him, Assistant State's Attorney Gina Cirincion said Thursday in court.

Circuit Judge John H. McDowell sentenced Nguyen to two years in prison with all but 155 days suspended. McDowell then gave Nguyen credit for the 155 days he had served in jail.

A representative of the state's attorney's office said in court Thursday that the victim didn't want to testify.

Cirincion felt the rape charge would be difficult to prove in front of a jury because Nguyen and the victim had consensual sexual relations after the assault, she said.

Nguyen, who came to the United States from South Vietnam in 1991, spoke to the judge through a Vietnamese interpreter. Nguyen was going to be held by immigration authorities until he could prove citizenship.
