Mont Alto man sentenced in crash in which woman was injured

CHAMBERSBURG, Pa. -- A Mont Alto, Pa., man convicted of seriously injuring a woman in a 2006 accident was sentenced Wednesday in Franklin County Court to 18 months in Franklin County Jail.

Troy Lee Rowles, 36, of 6 Penn St., pleaded guilty Dec. 19 to aggravated assault with a vehicle while driving under the influence. Judge John R. Walker's sentence included seven years on probation and made Rowles eligible for work release.

Rowles was ordered to pay $21,638.28 in restitution toward the medical expenses of the victim, 59-year-old Evelyn Gimbara of Shippensburg, Pa. Walker did not order restitution requested by a personal injury law firm of $227,000 to $341,000 for lost wages from the time of the accident to when Gimbara is either 66 or 70 years old, according to court records.

The accident happened Nov. 1, 2006, at 11:10 p.m., Pennsylvania State Police said. Rowles was southbound on U.S. 11 in Greene Township near Lippizan Drive when his vehicle crossed into the northbound lane, striking Gimbara's vehicle head-on.

Gimbara, who later was taken to Hershey (Pa.) Medical Center, had a torn aorta, as well as a broken hip, wrist, leg, elbow and ribs. Gimbara was using a walker when she appeared in court.

Rowles told police he had been to a bar in Shippensburg before the accident. Witnesses who were behind Rowles as he was driving told police he crossed the center line several times and almost caused other accidents before the collision, according to the affidavit of probable cause.

Police said Rowles had a blood-alcohol content of 0.268 when tested after the accident, more than three times the legal limit for intoxication in Pennsylvania of 0.08 percent.
