MARTINSBURG, W.Va. - A woman who failed to appear in Berkeley County Magistrate Court this week on charges she failed to pay vendors who took part in a fundraiser for a terminally girl in April 2007 was arrested and placed in Eastern Regional Jail on Thursday.

Jennifer Nicole Swartz, 34, of O'Connor Lane, in Martinsburg, was charged last year with a felony count of obtaining money by false pretenses and five misdemeanor counts of writing worthless checks, according to court records.

Swartz was in jail Thursday on a $3,500 bond, according to jail records.

Magistrate Jim Humphrey on Tuesday issued a capias, or bench warrant, for Swartz' arrest about 45 minutes after she was scheduled to appear for a preliminary hearing.

The fundraiser for the girl was held in April 2007 at War Memorial Park in Martinsburg and the child's medical condition has reportedly worsened since the event.

According to court records, Swartz did not give any of the event proceeds to the child's family and police have alleged she wrote checks amounting to more than $1,500 for shirts, balloons, moon bounces, concessions and other services for the fundraiser.
