Man charged on counts of sexual abuse

MARTINSBURG, W.Va. - A Berkeley County man who police learned was previously arrested for indecent acts with a child was arraigned Tuesday on four counts of sexual abuse, according to Berkeley County Magistrate Court records.

Henry Nils Hale Jr., 44, was arraigned by Magistrate Sandra L. Miller, who set a $100,000 bond.

According to a complaint filed by West Virginia State Police Sgt. D.E. Boober, the four alleged sexual encounters between Hale and a teenage girl happened between March 2006 and August 2007.

The victim told police she was told not to tell anyone about what had happened at a Berkeley County residence and at least one other location or they both would get in trouble, Boober said in his complaint.

Three men arrested in cocaine sting

MARTINSBURG, W.Va. - A $2,000 cocaine deal set up by members of the West Virginia State Police and the Eastern Panhandle Drug and Violent Crime Task Force led to the arrest of three men near the Martinsburg Mall on Tuesday, according to Berkeley County Magistrate Court records.


Berna Hernandez Custodio, 28, no known address; Raul Lopez Aquino, 27, Longview, Wash.; and Jorge Luis Juarez Salinas, 32, of Leesburg, Va., were arraigned by Magistrate Sandra L. Miller, who set a $50,000 for each case, records show.

Custodio was charged with possession of a controlled substance with intent to deliver and Aquino and Salinas were both charged with conspiracy to deliver the drug, according to a complaint filed by State Police Trooper C.A. Ellwanger.

The deal for 2 ounces of cocaine initially had been planned on Monday to take place at an Inwood, W.Va., area club, but that was scrapped for the mall location near the J.C. Penny store, according to Ellwanger's complaint.

Arrest made in 2003 business break-in

MARTINSBURG, W.Va. - A 50-year-old man wanted by authorities since 2003 for allegedly breaking into a downtown Martinsburg business where $430 later was reported missing was arraigned on Monday for his alleged role in the crime, according to Berkeley County Magistrate Court records.

Charged with one count of breaking and entering, Stanley Mitchell Bell of 26 Lillian Way, in Martinsburg, was arraigned on Monday by Magistrate Joan V. Bragg, who set a $10,000 bond, according to court records.

The man allegedly took part in the break-in of the Blue White Grill at 101 N. Queen St., on July 21, 2003, according to a complaint filed by then Patrolman A.J. Mancine. The complaint against the man was signed in November 2003 by Magistrate Sandra L. Miller and Bell had been residing at 213 S. Raleigh St., at that time, according to court records.

At the time of the break-in, Mancine said in his complaint that the man was a cook at the restaurant and often closed the business in the evenings.

Cashier charged in theft

MARTINSBURG, W.Va. - A 20-year-old man charged with pocketing cash from his assigned register at Wal-Mart in Martinsburg was arraigned on one count of embezzlement over the weekend, according to Berkeley County Magistrate Court records.

Davon Lamar Fletcher of 102 Eclipse Court, in Martinsburg, was arraigned by Magistrate Jim Humphrey, who set a $10,000 bond.

According to a complaint by Martinsburg Police Department Patrolman E. Gibbons, surveillance video captured the man slipping money into his pockets at least three times in August and September 2007 and store officials determined that $1,460 was missing from the man's register.

"I asked Mr. Fletcher for his name and he stated, 'I'll own up to it. I just want to pay the money back,'" Gibbons said of his initial conversation with the man in the officer's complaint.
