July 15, 2007|By ANDREW SCHOTZ

MARTINSBURG, W.VA.-A Berkeley County, W.Va., man who was injured Thursday in a fight involving his brother and another man has died, West Virginia State Police said Saturday.

Douglas "Scott" Funk II, 23, of 244 Dinner Belle Court in the Brookstone subdivision north of Hedgesville, died Friday night, police said.

Funk previously was listed in critical condition at City Hospital in Martinsburg.

Christopher Michael Speikers, 21, of 13095 Back Creek Valley Road in the Tomahawk section of Berkeley County, was charged with one felony count of malicious assault after the fight, according to Berkeley County Magistrate Court records.

Police said Saturday that no new charges have been added.

Speikers was being held Saturday night at the Eastern Regional Jail near Martinsburg in place of $15,000 bail.

A complaint filed by West Virginia State Police Senior Trooper J.S. Chumley says Speikers told police that he intervened in a fight between Funk and Funk's 15-year-old brother.

While Funk and Speikers fought, Speikers put Funk in a chokehold and Funk stopped moving, police said.

The fight happened at Funk's home, police said.
