Man faces charges in sex assault on girl, 11

HAGERSTOWN - A Hagerstown man was charged Thursday with the kidnapping and rape of an 11-year-old girl last month, according to a Washington County Sheriff's Department press release.

James E. Hackey Jr., 39, of 238 Hager St., was charged with 17 counts, including two counts of rape and one count of sodomy, after allegedly sexually assaulting the girl after taking her from a bedroom at Oak Ridge Apartments on Downsville Pike in the early morning hours of May 10.

The Commissioners Office of the Washington County District Court reported Thursday night that Hackey is being held without bond at the Washington County Detention Center.

Two of the counts against Hackey - rape and sexual offense - each carry a maximum sentence of life in prison if he is convicted, according to the release.


All together, Hackey is charged with two counts of rape, four counts of sexual offense, one count of sodomy, one count of unnatural and perverted sexual practice, one count of kidnapping, one count of abduction, one count of assault, one count of Peeping Tom, two counts of theft and three counts of burglary, according to the release.

The sheriff's department reported that Hackey climbed through the girl's ground-floor bedroom window on May 10 about 4:35 a.m. and abducted her. He then took her to the apartment complex's basketball courts, where he raped and sodomized the girl and forced her to give him oral sex, according to sheriff's department reports.

The girl's 8-year-old sister was in the room, and reportedly talked to Hackey as the incident occurred, according to reports. When the sister said she would alert adults, Hackey gave her money to be quiet, according to reports.

He also showed the sister a picture of a little girl in his wallet, trying to reassure her that he wouldn't harm them, the reports showed. Hackey then took the 11 year old to the basketball courts, according to reports.

After a search of the crime scene, authorities reported that they found a condom wrapper, latex gloves and a bottle of lubricant, according to reports.

The reports showed that Hackey fled when the girl told him she saw someone coming with a flashlight. She then ran back to her apartment, according to reports.

On Wednesday, the sheriff's department received a report that a black male was looking in windows at Oak Ridge Apartments.

Authorities went to the area and found Hackey, according to reports. After questioning, he was linked to burglaries at the apartment complex from items that he had pawned.

During a Thursday search of Hackey's home, investigators found latex gloves and the same brand of condom that was found at the crime scene, according to reports. A picture of a little girl was found as well, according to reports.

Hackey was arrested in an upstairs room.

The picture was shown to the victim and her sister, who identified it as the same picture that Hackey had showed them the morning of the crime, according to reports.
