Rejected inspection leads to drug arrest

MARTINSBURG, W.Va. - A Berkeley County man driving a vehicle with a rejected inspection sticker on it was stopped by West Virginia State Police who not only cited him for the violation, but arrested him on a drug-dealing charge, according to Berkeley County Magistrate Court records.

Van Tyrone Smith II, 27, of 55 Fiser Lane in Martinsburg, was arraigned Tuesday by Magistrate Joan V. Bragg, who set bond at $25,100. He was cited for driving on rejected inspection and charged with possession with intent to deliver marijuana.

Trooper F.H. Edwards said in his complaint that he stopped the blue Mercury sedan that Smith was driving on Brown Road off U.S. 11 about 11 a.m.

When advised of the violation, Edwards said Smith told him that he was driving from AutoZone, where he checked on how much brake pads would cost. Edwards said Smith acknowledged that he had several bags of marijuana beneath the driver's seat of the vehicle after Smith was asked to step out of the vehicle to hear the trooper's explanation of the inspection violation.

Edwards then retrieved eight bags of marijuana, each containing 3 grams, the trooper said.
