January 17, 2007

A 16-year-old girl who went to a party allegedly was raped in a bathtub, where witnesses said they found her passed out and covered in vomit, according to a Washington County District Court charging document.

John Lynn Miles Jr., 18, of 807 S. Potomac St. in Hagerstown, was being held Tuesday on $500,000 bond at Washington County Detention Center, a deputy said. He is charged with second-degree assault and second-degree rape, court records show.

A charging document states the girl and a 14-year-old friend went to a party at Miles' home after they each told their parents they planned to spend the night of Dec. 28 at the other's home. The girl's mother later found her daughter at the party early on the morning of Dec. 29 intoxicated and wearing different clothes, the document states.

A person at the party told police that he found the girl in the bathtub with her pants pulled down and Miles allegedly on top of her, the document states. Though the girl was covered in vomit, Miles allegedly was kissing her and engaging in sex, the document states.

According to the charging document, the girl did not remember anything after drinking about half a can of beer Miles allegedly gave her. She said people at the party had discussed buying ecstasy pills, but she did not see any of the drugs, the document states.

At Washington County Hospital, the girl registered a blood-alcohol level of .12 percent, the document states.
