Three men jailed following searches of borough homes

WAYNESBORO, Pa. - Three men were in jail Tuesday after police searched two borough residences last week.

Waynesboro Police said Timothy Simmons, 35, Kevin Wagaman, 42, and Daren Misner, age unknown, were taken into custody after police searched two homes Dec. 14 and 15.

Police said the incident began Dec. 14 around 11:50 p.m. when officers patrolling Pratt Court saw a man wanted by the Franklin County Sheriff's Department. The man, later identified as Misner, ran from the scene, police said.

According to Waynesboro Police Chief Ray Shultz, officers went to 583 Pratt Court looking for Misner, and found Wagaman and Simmons. During a search of the residence, police said they found drug paraphernalia and cocaine. Police said the cocaine was found under a pillow being used by Simmons, who identified himself as John Miller of Hagerstown.

Shultz said Wagaman was taken into custody and released to the Franklin County Probation Department for a probation violation. He said Simmons was arraigned before Magisterial District Judge David Hawbaker on charges of false identification to law enforcement officers and possession of a controlled stubstance (cocaine). Police said Simmons was committed to Franklin County Prison.

Police received a call around 12:40 a.m. Dec. 15 saying that Misner was seen at 72 Walnut St. Shultz said police searched the Walnut Street residence and found Misner hiding in the ceiling area of the gargae.

Police said he Misner released to the Franklin County Sheriff's Department, which had a bench warrant for his arrest.

A Franklin County Prison spokeswoman said Tuesday that all three men were still in jail. Misner was being held on unrelated charges of simple assault and harassment; Wagaman was being held on a probation violation.
