Former Berkeley Co. sewer district director indicted again

MARTINSBURG, W.Va. - Former Berkeley County Public Service Sewer District director Walter H. "Walt" Sebert Jr. has been indicted again by a grand jury on a count of embezzlement, according to charging documents released Thursday by Prosecuting Attorney Pamela Games-Neely's office.

The 54-year-old Martinsburg man is charged with embezzling $31,617.35. A list of more than 200 items allegedly purchased improperly includes a high back chair, $938 in telephone service at his residence, a $53 lambs wool sweater, "non-gas items" from an Exxon station and at least one yearly bonus of $2,550, according to the indictment.

Sebert, of 163 Noel Drive, originally was indicted on 11 counts of counterfeit credit card possession and one felony count of embezzlement. He was fired in May 2004 by the service district's board of directors, records show.

The 11 counts were dismissed in August after Games-Neely told 23rd Judicial Circuit judge Christopher C. Wilkes they were wrongly based upon the evidence collected in the investigation of the matter.

Wilkes allowed Games-Neely to retain the right to prosecute Sebert on the embezzlement count after the judge ruled she could not amend the indictment to correct "inartful" legal wording in the February true bill.

In addition to Sebert, true bills handed up by grand jurors in their third and last day of proceedings for the October term, included:

· Eric Wayne Friend, 41, of 402 Tanbridge Drive, Martinsburg, on counts of sex offender registration violation.

· Michael R. Francesconi, 29, of 86 Weller Drive, Martinsburg, on count of driving revoked driving under the influence third offense.

· Brian C. Kilmer, 29, of P.O. Box 1504, Inwood, W.Va., on counts of driving revoked DUI third offense, expired registration, failure to use a turn signal.

· Lucretia E. Kiss/aka Lucretia Gift, 24, of 122 Woodland Court, Charles Town, W.Va., on counts of attempted fraudulent use of an access device, forgery, uttering, five counts of fraudulent use of an access device, two counts of conspiracy, three counts of attempted credit card fraud and four counts of credit card fraud.

· Alysia D. Ludwig, 31, of 806 Catawba Drive, Berkeley Springs, W.Va., on two counts of possession with intent to deliver a controlled substance and transfer of a controlled substance into West Virginia.

· William R. Klahre, 47, of 2211 Koontztown Road, Falling Waters, W.Va., on counts of possession with intent to distribute crack cocaine, and possession of less than 15 grams of marijuana and cocaine.

· Joshua Allen Karns, 19, of 1079 Archer Road, Kearneysville, W.Va., on counts of entering without breaking, grand larceny and conspiracy.

· James E. McFarland IV, 22, of 6494 Winchester Ave., Inwood, W.Va., on two counts of possession with intent to deliver heroin, and first-degree domestic battery.

· Keith G. Meiklejohn, 21, of 377 Shady Brook Road, Clearbrook, Va., on a count of possession with intent to deliver cocaine.

· Christopher B. Resh, 34, of 650 Braddock Blvd., Inwood, W.Va., on a count of driving under the influence third offense.

· Charles T. Ludwig, 45, of P.O. Box 897, Moorefield, W.Va., on a count of failure to pay child support.

· Allen D. Vance, 49, of 2499 Koontztown Road, Falling Waters, W.Va., on counts of possession with intent to deliver marijuana and cocaine.

· James E. DuBose, 38, of 1004 Virginia Ave., Martinsburg, on a count of failure to pay child support.

· Shawn D. Wasson, 27, of 700 Winchester Ave., Martinsburg, on counts of petit larceny second offense and conspiracy.

· William A. Dunlap, 42, of 47 Jones Drive, Hedgesville, W.Va., on counts of fleeing from a law enforcement officer while driving under the influence of a controlled substance, attempted malicious assault of a police officer, obstructing an officer, driving left of center, failure to stop at a stop sign, reckless driving, registration violation and DUI first offense.

· Shane William Evy, 28, of P.O. Box 292, Shenandoah Junction, W.Va., on seven counts of credit card fraud.

· Larry A. Parkinson, 42, of 704 Virginia Ave., Martinsburg, on a count of grand larceny of an automobile.

· Shawn Clayton Franklin, 34, of 1387 Allensville Road, Hedgesville, W.Va., on counts of wanton endangerment, fleeing on foot and obstruction.

· Sean G. Ott, 34, of 228 Euclid Ave., Charles Town, W.Va., on counts of sexual assault second degree and two counts each of sexual abuse first degree and sexual abuse third degree.

· Paul D. Rene, 41, no fixed address, on two counts of sex offender registration violation.

· Christopher Myers, 23, of Loop Road, Gerrardstown, W.Va., on counts of counterfeiting, conspiracy and possession of counterfeit money with intent to utter.

· Michael S. Parker, 40, of 201 N. Kentucky Ave., Apt. 112, Martinsburg, on counts of sexual assault first degree and sexual abuse by a guardian or custodian.
