Know more on ethanol plant plan

September 06, 2006

The issue: Penn-Mar Ethanol wanted to build an $80 million ethanol plant near Letterkenny Army Depot near Chambersburg, Pa. In July, the sales agreement for the land expired after numerous legal challenges and opposition groups hampered the project.

What's new: The Pennsylvania Commonwealth Court has dismissed an appeal by Penn-Mar Ethanol of a Franklin County Court decision in a ruling that proved to be another blow against the York, Pa., partnership's effort. The court ruled in favor of a motion by Citizens for a Quality Environment, which opposed the project, to dismiss the appeal for "loss of standing."

What's next: Penn-Mar still has the option of trying to purchase the land and go through the permit and public hearing process to get the project approved.
