Man charged in pa. pharmacy robbery waives court hearing

CHAMBERSBURG, Pa. - Marty William Maness, who is charged in the June 26 armed robbery of the Modnur Inc. Pharmacy in St. Thomas, Pa., waived his preliminary hearing Monday in Franklin County (Pa.) Court.

The woman identified by Pennsylvania State Police as his accomplice, Kathy Jo McFadden, had her preliminary hearing continued by her attorney.

Maness, 43, of Thompson Road in Needmore, Pa., is scheduled for mandatory arraignment Aug. 16 in county court. He remains in Franklin County Prison in lieu of $75,000 bail.

McFadden, 34, of 208 W. High St. in Hancock, was released on $50,000 unsecured bail following arraignment before Magisterial District Judge Duane Cunningham in Greencastle, Pa., last week.

Maness is charged with robbery, criminal conspiracy to commit robbery, aggravated assault, theft and reckless endangerment. Police allege he stuck a handgun to a man's chest and demanded OxyContin and Percocet.

McFadden, who has been charged with robbery, criminal conspiracy to commit robbery and theft, entered the pharmacy at 4495 Lincoln Way West around noon and surveyed the interior, police allege in charging documents.

Police allege the pair stole $2,342 of OxyContin and Percocet and left in a red station wagon that later was stopped by state troopers in Fulton County, Pa.
