Man faces sex charges

A Funkstown man faces charges stemming from an alleged rape in Hagerstown.

Mihai Simiusca, 49, of 110 Chestnut St., Apt. 8, is charged with second-degree rape, fourth-degree sex offense and second-degree assault for allegedly assaulting a female acquaintance June 11 at her apartment in the 100 block of North Potomac Street.

According to court documents, Simiusca helped the victim to her bedroom after she became drunk at the party, which started about 1 or 1:30 p.m. June 11.

The victim, who said she drank more than 12 beers, passed out, and when she awoke, she realized her shorts had been pulled down and Simiusca was behind her with his pants down, documents allege.

According to the documents, the victim threw objects at Simiusca's head after she got up from the bed. One of the items struck Simiusca, causing him to bleed, the documents state.

Police responded to the address at 7:54 p.m., according to court documents.

Both the victim and the victim's friend, who was at the cookout, identified Simiusca from lineups, documents state.

Bail for Simiusca was set Friday at $400,000. A Washington County Detention Center spokeswoman said Monday he was not at the facility.
