Man, 75, indicted in fatal crash

A 75-year-old Clear Spring man has been indicted in connection with the Dec. 1, 2005 traffic accident that claimed the life of 21-year-old Dalen Daniel Snell, according to a Maryland State Police written release.

Wayne Eugene Baker, of 11722 Big Spring Road, turned himself in to state police Friday on an open Circuit Court warrant, issued following a Washington County grand jury indictment in connection with the accident, police said.

He was taken before a District Court Commissioner and released on personal recognizance, according to the release.

Snell, of Hagerstown, was pronounced dead at the scene of the reported 8:39 p.m. head-on collision on U.S. 40, one mile east of Huyetts.

According to police, Snell was a passenger in 22-year-old Justin Arthur Davis' 2001 Saturn, which was struck by a 2001 Ford Focus, driven by Baker.

Baker was traveling west on U.S. 40 when he lost control of his car, crossed the eastbound lane and struck Davis' car near Burkholder Lane, police said.

Davis and Baker were taken to Washington County Hospital for treatment, police said.

Baker is charged with negligent manslaughter, negligent homicide, negligent homicide by motor vehicle while impaired, driving under the influence, driving under the influence per se, driving while impaired, reckless driving, negligent driving, life-threatening injury by motor vehicle while under the influence of alcohol and life-threatening injury by motor vehicle while impaired by alcohol.
