Man faces 2 counts in accident that killed his brother

CHARLES TOWN, W.Va. - A Jefferson County, W.Va., man was charged Tuesday with two counts of DUI felony death following a car accident in the Shannondale area on New Year's Eve in which the man's brother and another man were killed, according to court records.

Darryl Wayne Dodson Jr., 22, of Millville, W.Va., was being held Tuesday afternoon in Eastern Regional Jail on $50,000 bond, a jail spokesman said.

In addition to the DUI charges filed against Dodson, he also faces charges of reckless driving, failure to maintain control, unauthorized use of a motor vehicle and no operators, according to Jefferson County Magistrate Court records.

Herbert James Dodson, 21, of Millville, Darryl Dodson's brother, and John Huse Sr., 34, of Charles Town, died in the crash, police said.

The accident occurred about 5:43 p.m. on Mission Road when a 2001 Ford Taurus sideswiped a tree, then went back onto the road, coming to rest facing the wrong direction, said Deputy Scott Reagan of the Jefferson County Sheriff's Department.

Herbert Dodson was in the road after the wreck and Huse died after being removed from the wreckage, police said.

Darryl Dodson, the driver, was treated at Inova Fairfax Hospital.

An eyewitness to the crash pointed out the driver, who was sitting in a driveway. A strong odor of alcohol was coming from the man's breath and his eyes were red, according to a criminal complaint filed in magistrate court.

A statement was obtained from a woman who said she was Darryl Dodson's girlfriend and that they had gone to Herbert's Dodson's house to visit, according to the criminal complaint. John Huse was present, the complaint states.

"She advised that Darryl, Herbert and John were all drinking Jack Daniels," the complaint alleges.

Numerous alcohol containers were observed at the accident scene, records state.
