W.Va. men face drug charges

MARTINSBURG, W.Va. - Two Martinsburg men were charged Tuesday with allegedly fleeing from police following a traffic stop, during which drugs were later discovered in their car, police said.

Derrick J. Byrd, 24, of Lanee Drive in Martinsburg, and 27-year-old Aaron E. Jackson of State Circle both were charged with possession to distribute crack cocaine after being stopped by West Virginia State Trooper Cpl. T. Kearns while on patrol near Martins Landing Apartments in Martinsburg. The officer stopped the car on Dry Run Road after observing a brake light out, according to police records.

Jackson, who has a criminal history dating to 1997 for convictions in Pennsylvania, West Virginia and Ohio, also was charged with battery on an officer and fleeing on foot, after allegedly striking Kearns in the chest with his shoulder while the officer struggled to handcuff him. He was captured following a brief foot chase, police said.

Byrd also was charged with obstructing an officer after leaving the car while Kearns chased Jackson, police said. He was later caught in a nearby apartment complex. Three individually wrapped bags of crack cocaine were discovered hidden beneath the car's center console during a search of the car, police said.

Jackson, who also was issued citations of driving with a suspended Pennsylvania driver's license and driving with a brake light out, was being held at Eastern Regional Jail on $50,100 bail, after being arraigned by Berkeley County Magistrate J.A. Humphrey.

If convicted, he faces from one to 15 years in jail and/or a $25,000 fine on the drug charge and up to a year in jail and fines on the battery and fleeing charges.

If Byrd is convicted, he faces from one to 15 year in jail and/or a $25,000 fine on the possession charge and up to a year in charge for the obstruction charge.

He is being held Wednesday at Eastern Regional Jail on $43,000 bail.
