Construction flagman struck, injured

A flagman was taken to Washington County Hospital following an accident Monday on U.S. 40, according to a news release issued by Maryland State Police.

Police said John Hamil, of Chambersburg, Pa., was injured in an accident reported at 9:38 a.m. on U.S. 40 near Spickler Road.

Police said a 1999 Mercury Sable driven by Marcel Wenker of Big Pool swerved to avoid striking a Ford Explorer that was stopped for construction on U.S. 40.

Police said the Sable struck the right rear of the Ford before striking Hamil, who was standing on the right shoulder of the road.

Police said Hamil's injuries were not life-threatening.

A Washington County Hospital spokeswoman said Hamil was in fair condition Monday.

Wenker was charged with failure to control speed to avoid a collision, according to police.
