Pa. man charged with indecent assault waives hearing

CHAMBERSBURG, Pa. - A Greencastle, Pa., man listed on the Pennsylvania State Police Web site of sexual offenders in Franklin County waived his preliminary hearing Tuesday in central court on charges of indecent assault involving a minor.

Franklin E. Kesselring, 48, of 6303 Hager Drive, waived his preliminary hearing on two counts of indecent assault and was scheduled for mandatory arraignment in county court on July 13, according to the Court Administrator's Office.

Kesselring had been convicted in North Carolina on a charge of indecent liberties with a child, Assistant District Attorney Matthew Fogal said. A criminal background check of Kesselring did not turn up any convictions for sexual crimes in Franklin County, Fogal said.

Waynesboro police were called to Sheetz at 102 E. Main St., on the morning of May 10, according to the affidavit of probable cause. A girl told police she had been walking to school down a nearby alley when a man in a garbage truck waved at her, police said.

The girl told police that as she approached the truck, the man pulled the truck up beside her and got out. The man told the girl his name was Frank and then fondled and tried to kiss her before she pushed him away, police said.

Police found Kesselring in a garbage truck in the CVS parking lot and he told them he had talked to a girl behind the Sheetz store, according to the affidavit. Police said, however, that a Sheetz surveillance video showed that Kesselring did not speak to anyone behind the store.

A surveillance video from the First National Bank of Greencastle on East Main Street showed the garbage truck turning into the alley at approximately the same time the girl said the incident took place, police said.

Kesselring was being held Tuesday in Franklin County Prison, Fogal said.
