Pa. woman charged with animal cruelty fined $100

CHAMBERSBURG, Pa. - A Waynesboro, Pa., woman charged with cruelty to animals in the death of a dog last year pleaded guilty to a summary offense Monday in Franklin County Court, but the sentencing of her former boyfriend was postponed.

Sharon Black, 44, of 807 W. Main St., originally was charged with first-degree misdemeanor cruelty to animals in the death of the small white dog, which was found alive in a trash container at the Landis Gardner plant in Waynesboro on Jan. 11, 2004.

Assistant Public Defender Jeremiah Zook said she was allowed to plead to a summary charge because of her assistance in the prosecution of Dallas Davis, 37, formerly of the same address.

Judge John R. Walker Wednesday fined Black $100 for the offense, Zook said.

Davis, 37, formerly of the same address, is serving one to 10 years in state prison for a drug delivery charge, according to court records. He was scheduled to be sentenced Wednesday on the first-degree misdemeanor charge of cruelty to animals, but was not taken from the state prison where he is serving the delivery sentence because of Monday's snow, said his attorney, James Reed.

Reed said Wednesday a new sentencing date has not been set. Davis faces up to five years in prison on the cruelty charge to which he pleaded guilty on Jan. 6.

When the small white dog was found in a trash bag in the trash container, it had splints on its front legs made of duct tape and parts of a folding ruler, according to the Waynesboro police criminal complaint. A veterinarian who examined the dog said the injuries appeared to be one or two weeks old.

Black, who worked at Landis Gardner at the time, gave police conflicting stories about the dog. She later told them that Davis had broken the dog's front legs with a walking cane and then threatened her with violence unless she disposed of the animal, according to the affidavit of probable cause.
