Man faces sodomy, sexual assault charges

A Hagerstown man was arrested Friday morning on sodomy and sexual assault charges after a homeless man alleged that the man assaulted him while he slept.

Billy Joe Sparks, 35, of 136 Broadway, Apartment 2EF, is charged with sodomy, second-degree assault and second-degree sex offense related to the July 6 incident, the Hagerstown Police Department said in a written release.

Police said that on July 6, a 42-year-old homeless man reported that while he was walking in the 700 block of Broadway, Sparks approached him and said that the homeless man could stay at his apartment for the night.

After arriving at Sparks' then-apartment, 59 Broadway, Apartment 3, Sparks put a pornographic video in the VCR for them to view, police allege. The victim had been drinking alcohol and passed out and when he awoke, he was being sexually assaulted, police allege.

After the alleged assault, the victim was told to leave the apartment. He reported the incident to police at 6:45 a.m. July 6, police said.

The victim was treated at Washington County Hospital on July 6 and released, police said.

Sparks was being held on a $60,000 bond at the Washington County Detention Center Friday night, a jail spokeswoman said.
