Man charged with robbery and battery

MARTINSBURG, W.Va. - A Martinsburg man was arraigned Monday in connection with an incident in which a man was beaten and robbed of $3.

Martell Andrew Mignott, 18, of 26 Berkeley Garden Drive, was charged with a felony count of robbery and a misdemeanor count of battery, which stemmed from an unrelated incident.

The robbery happened at around 12:30 a.m. on June 17 in the parking lot of Berkeley Gardens, an apartment complex outside Martinsburg.

When Deputy Jarrett Jones arrived, the victim, Eric Franzen, was gone. Jones later found out that a friend had driven him to a hospital, he said.

Two witnesses told the deputy that a man hit the victim, whom they described as being an older man, until he fell to the ground. The assailant kicked the man until he was unconscious and then took all of the man's money - $3, according to the witnesses.

The battery charge stemmed from an incident in the same parking lot on Feb. 2.

According to court records, Mignott approached a man he did not know, Matthew Killian, in the parking lot and asked for a drink from Killian's bottle of liquor. Killian obliged.

"Sometime shortly thereafter the defendant (Mignott) decided he wanted the whole bottle of the liquor," Jones alleged in court records. "The defendant punched the victim in the left eye and took the remaining liquor."
