Boy charged with rape

Three days after a 10-year-old Hagerstown girl had a miscarriage, Hagerstown City Police charged a 15-year-old boy with second-degree rape, Hagerstown City Police said.

The teen, detained in a juvenile holdover facility since Friday, also is facing charges of second-degree assault and fourth-degree sex offense, Lt. Rick Johnson said Sunday.

Johnson said last Tuesday the initial assessment was that the pregnancy "may have been as a result of a consensual sexual relationship with the girl's 15-year-old boyfriend."

By Maryland law, the age of the girl coupled with the age of the boyfriend led to the charges.

Shortly after 5 a.m. Tuesday, police went to a residence in the west end of Hagerstown for a report of a juvenile in need of medical attention, Johnson said.


A woman identified as the girl's mother escorted officers upstairs, where they saw the 10-year-old girl in the bathroom with a stillborn fetus on the floor.

Johnson, who was called in on the case, said an ambulance from Community Rescue Service responded and took the 10-year-old girl to the Washington County Hospital emergency room for treatment.

The initial medical assessment revealed the girl had miscarried an approximately 4-month-old fetus, Johnson said.

Detectives responded to the hospital to conduct the follow-up investigation. The girl was released from the hospital sometime last week.
