Teen pleads guilty to assault

HAGERSTOWN - A 17-year-old who had been charged with attempted murder of a Hagerstown man has pleaded guilty to a lesser charge.

Charles E. Kelley, of 980A Security Road, pleaded guilty in Washington County Circuit Court on Oct. 24 to first-degree assault, according to court records.

Circuit Judge Frederick C. Wright III ordered that Kelley remain in custody without bond while a pre-sentence report is compiled.

Kelley was stopped on Wesel Boulevard on May 28 about 40 minutes after Marvin Eugene Moyer, 31, of 950B Security Road, was shot in the upper left thigh.

Police classified Moyer's injury as a flesh wound.

Kelley was charged as an adult with attempted first- and second-degree murder, first- and second-degree assault, reckless endangerment and three handgun offenses.

Police said at the time that a prior argument between Kelley and Moyer sparked the shooting outside Moyer's home.
