BERKELEY SPRINGS, W.Va. - A Guatemalan man who sat down in the middle of U.S. 522 outside of Berkeley Springs was hit by a tractor-trailer Sunday night and pronounced dead at the scene.

Police have not yet been able to contact the family of 40-year-old Otilio C. Peralta, said West Virginia State Trooper E.D. Widmeyer.

The accident happened around 11:50 p.m. as Albert Quick, 57, who was driving a 2002 Volvo tractor-trailer owned by Tennessee-based First Fleet Inc., headed north toward Berkeley Springs.

Peralta, who, according to police, had just left a bar with another man, sat down in the middle of the northbound lane for some reason, Widmeyer said. His friend, who does not speak English, spoke through an interpreter.

The tractor-trailer driver was not cited.

Widmeyer said Monday evening he was trying to determine if Peralta was in the country legally.

Peralta was apparently here looking for work, Widmeyer said.

Toxicology tests, used to determine if and how much alcohol was present in Peralta's body, will not be done, Widmeyer said.
