Case on hold until cause of death determined

CHAMBERSBURG, Pa. - The case against a Chambersburg man charged with aggravated assault following an attack on his brother last Thursday will remain on hold while pathologists determine the victim's official cause of death, a Chambersburg police investigator said Tuesday.

Bacilio Santos Martinez, 39, of 213 S. Main St., is being held on $1 million bond in connection with the beating of his brother, Pablo Santos Martinez, 51, police said.

Pablo Martinez died Friday night at Chambersburg Hospital.

The cause of death is being withheld pending the results of an autopsy performed Tuesday and other tests, said Detective Sgt. Diane Kelso of the Chambersburg Police Department.


"I can only say that no new charges will be filed until the results of further tests are in," Kelso said. She said she could not say when the results will be available.

Jeffrey B. Conner, Franklin County coroner, predicted it could be several weeks.

Police responded to an apartment at 213 S. Main St. at 1 a.m. Thursday for a report of an unresponsive person. Pablo Martinez was taken to the hospital with life-threatening injuries, court records said.

Investigators were told by witnesses, who spoke to them through an interpreter, that the victim was hit on the head by his brother during a fight, court records said.

A preliminary hearing on the aggravated assault charge is scheduled Friday before District Justice Gary Carter in Chambersburg.
