Man charged with DUI resulting in death

A man who allegedly drove his truck head-on into a car on U.S. 11 almost four months ago was arrested Friday on a warrant charging him with drunk driving.

Daniel Scott Pearrell, 26, of 1719 Rock Cliff Drive, Martinsburg, is facing one count of driving while under the influence, resulting in death.

Berkeley County Magistrate Joan Bragg arraigned Pearrell and set bail at $10,000. An official at Eastern Regional Jail outside Martinsburg said Friday night that Pearrell was no longer at the jail.

Pearrell was driving a 1971 Chevrolet Blazer south on U.S. 11 north of Martinsburg about 9:15 p.m. on March 30, according to West Virginia State Police. Pearrell's truck crossed the center line and collided with a northbound 1990 Geo Storm driven by Ermain Espinoza Rivera of Inwood, W.Va., police said.


Rivera and a passenger, Juan Tejeda, 20, of Wheaton, Md., were rescued from the Geo and flown to Inova Fairfax Hospital in Falls Church, Va.

Tejeda was pronounced dead at the hospital at 12:13 a.m., according to a police report.

State Police obtained a warrant for Pearrell's arrest on July 10.

A DUI with death conviction carries a sentence of one to 10 years in prison and a fine of $1,000 to $3,000.

Pearrell waived his right to have a preliminary hearing within 20 days. A date for his preliminary hearing was not scheduled Friday.
