Charges not dropped against track owner



MARTINSBURG, W.Va. - The Berkeley County Commissioners declined a suggestion Thursday that they drop a criminal charge against the owner of the controversial Mountaineer Raceway.

The charge against John Miller is a violation of a BOCA code, which relates to the building of a structure without a permit, said County Engineer Bucky Teach.

In a letter to county attorney Norwood Bentley, Martinsburg attorney Paul Weiss suggested the commissioners reconsider the case against Miller, particularly in light of the level of cooperation track owners have conveyed in working out problems at the track.

Commission President Howard Strauss said the commission cannot take any action because they have no inolvement in the charge against Miller, which was initiated by Teach.

The track, which features small car and motorcycles races, is off Tablers Station Road south of Martinsburg.

The racetrack, which has drawn complaints about noise and other problems from neighbors, was built in a floodway without permits, said Teach.

Track owners have come up with a plan to remedy the problems, such as installing seven additional culverts on the property to aid in flood relief on the property.
